brain. >> the result of a drunken showdown with authorities. abc7 news reporter ama dates is live at the medical center in san hoy say with the latest on this -- in san jose with the latest on this. ama? >> austin calhoun is now breathing on his own which is an improvement, but it is uncluer how well he is going to -- it is unclear how well he hillary cover. he sustained his injury when's he was shot with a projectile possibly in the head after he was trying to harm himself. this is 16-year-old austin calhoun before and after an incident with santa clara police early sunday morning. >> he was in the icu and he had brain surgery for a clot to be removed off his brain from blunt force trauma is what they said it was. >> the trauma happened after austin left the party intoxicated. he wandered to a fire station and called 9-1-1. several officers responded. >> they found a young man out in public holding a knife to his throat. >> santa clara police captain

says a negotiator was called in, but police were forced to act when austin came toward officers. they fired two rubber pro projectiles. austin fell to the ground and was handcuffed, but his dad says that wasn't all. >> they released the dog on him, and it bit him on the shoulder. it store up and down his back. >> he was brought to the medical center. >> sometimes he knows who i am and sometimes he doesn't. he doesn't know what year it is. >> doctors removed part of his skull to alleviate swelling. his family believes police used too much force. >> i don't think they were trying to hurt him. i just don't know why when someone is asking for help that they end up almost dying. >> it is a dangerous situation when you have somebody threatening to harm themselves with the knife out in public, but it actually moves in an aggressive manner toward the officers. we think they showed great

restraint in utilizing the devices they had rather than resorting to deadly force. >> and police are still investigating, so we don't have all of the facts in the case just yet. but again the family just wonders if more could have been done, if they could have negotiated longer. the dad is going around the neighborhood where it happened and trying to find anybody who may have surveillance video of what happened. in san jose, ama dates, abc news. >> thank you, ama. a bicyclist died in a crash after being hit by a dump truck in downtown berkeley. it happened after 3:30 on bancroft way into near fulton street. sky 7hd flew over the scene. the victim is a man in his 60s. investigators believe the driver of the dump truck unsnowingly hit the cyclist -- unknowingly hit the cyclist. he did so after being alerted by a passing driver. authorities are reviewing surveillance video from the area trying to determine exactly what happened. to hollywood now, the 36-year-old son of sylvester stallone was found dead today

in his home in san fernando valley. tmz is quoting sources saying a drug over dose may be the cause of death. >> a housekeeper found sage stallone's body at this studio city home and called police. friends had become concerned because they hadn't heard from him in the past day. a coroner's van showed up in the afternoon, but both the coroner's office and police said they were still in the early stages of the investigation and could not comment. sage moon blood stallone was the oldest of stallone's children. he appeared as an actor in several movies including in "rocky 5" and" day life -- "daylight." he started a company dedicated to preserving b movies from the 1970s and 1980s. sylvester stallone was attending comic-con when he heard of this news. he is devastated by the loss. sage stallone's attorney released a statement saying he wasn't depressed. he was thinking about getting married. he just had his whole life ahead of him.

a family spokesman called sage a talented and wonderfulungg man whose loss will be felt forever. sage stallone was 36 years old. a kennedy family member is denying tonight she was driving under the influence of drugs when she passed out behind the wheel. police found carrie kennedy when she sideswiped a tractor-trailer on a suburban highway. kennedy is the daughter of the late senator robert f kennedy and the ex-wife of governor andrew cuomo. they say she will be exonerated from the tests she took when she was arrested. >> a staff member died after collapsing at the campaign chicago headquarters. they say 29-year-old alex okent worked at the campaign's paid media department handling advertising. a campaign official said the president called okent's parents to offer condolences. >> a toddler was killed, and his grandparents critically injured in a house fire in san

bruno this morning. investigators believe candles on a religious altar could be to blame. it happened on lake drive. the cousin tells abc news that his grandparents were baby-sitting when the fire broke out. firefighters found the boy and his grandmother suffering from smoke inhalation. the toddler died at the hospital. a construction crew working next door saw the flames and and rescued the grandfather before firefighters arrived. >> and he told us that there was a two-year-old. we just went crazy trying to see if we could get him out, but there was no chance. >> i am praying right now my grandma and grandpa come back. i hope they make it. >> the grandmother is in critical condition tonight. the grandfather suffered serious burns. the family had its prayer altar in the hallway of the second floor near the bedrooms. federal maritime officials approved a new plan to protect whales in and around san francisco bay. it includes rerouting shipping traffic and establishing better ways to track

location. half a dozen whales have been killed by huge cargo ships as they come into port. just last month a 47-foot finish whale washed up on the beach in the point reyes national seashore. it showed it had a fractured spine and extensive injuries to its ribs and skeleton. they believe it was hit by a ship. three union city teen inning aers were arrested today and charged with what police are calling extreme vandalism. they are accused of breaking windows and burglarizing 32 cars parked in an underground garage at 24 union square drive. police say the suspects are a 16-year-old and two 14-year-olds who targeted expensive cars like this ferrari. >> they were described to me by the sergeant who went out there. he said it was the worst thing he ever had with so many cars broken into. 32 vehicles and he never had this kind of a number before. >> the three teenagers were released to their parents. they face charges including burglary, vandalism and auto theft. union city police are looking for the van -- van -- vandals

who poured what appeared to be headstones. a grounds keeper discovered it yesterday. a chapel spokesman says the headstones have been cleaned. no word on any motive for this. flagraw is on the table at a restaurant and they say it is in violation of the new california law. why the restaurant thinks they did nothing wrong. >> i didn't know i was illegal in california. >> she is not anymore. siri gets the go ahead from the governor. the new law that makes hands free texting legal. and the san francisco barista who sprung into action when somebody grabbed the tip jar. and then late other "nightline." >> i'm terry moran. coming up next on "nightline" it may look like a cry for help, but actually it is this stranded traveler scam. we find the guys bilking them out of millions.

the new california ban on the sale of flagra is being banned. instead of selling the duck liver the restaurant is giving it away for free. animal rights activists say it is against the law, and they protested there tonight. thomas roman is live at chef t.j.'s for us. >> carolyn, the restaurant which is behind me is now closed. the chef tells us he has been receiving hate e-mails from animal rights groups. he says it is because he was giving away flagra. >> stop flagra. it is against the law. >> it was turned in by a local resident forgiving away flagra. the restaurant has to be fined for serving the duck liver. the sale in production was banned after july 1st. the protesters showed up at the restaurant and they say

widespread, and over the bay and into our valleys tonight as you can see. it has deepened to about 2200 feet. and that just means with the wind flow coming offshore, it is just going to continue to push along into our inland valleys. it is well inland by morning. temperatures right now in the 50s to the low 60s. and as you look at the wind, it is an on shore flow that helped to drop the temperatures today. wind out of the southwest at fairfield. this is the delta breeze gusting to 30 ichs 6 miles an hour -- to 36 miles an hour. the marine layer is lifted up and pushed out toward the sacramento valley. so it is definitely going to be a cooler afternoon in our inland areas. cloudy overnight and patchy drizzle. a cool pattern for the weekend, and even cooler as we head into next week. i think you get the gist here. it is cool which is the operative word. tomorrow morning, drizzle. we are already seeing drizzle at the oakland airport and around san francisco we have seen spotty drizzle. first thing tomorrow morning, do count on it.

50s across the bay area. everyone starts out with the overcast skies and some drizzle around near the coast and the bay. clouds will pull back, but they don't quite clear the coastline. with the sea breeze going, temperatures held in the 50s in the afternoon and 80s inland. we will see partly sunny skies around the bay and mostly sunny in our inland communities. for your saturday, the south bay mid70s, santa clara, san jose, cupertino. on the peninsula you will see 72 in redwood city and 75 for loss altos. mid50s along the coast and breezy and cloudy most of the day. downtown san francisco 59 degrees. 56 degrees in the sunset district. in the north bay, you notice the narrower range of temperatures. not quite the 40-degree spread plus. 46 in the north bay and 71 for san rafael. east bay communities, mid60s berkeley, oakland 68 in hayward. you will see partly sunny weather in the afternoon. in our inland communities, well below normal for this time of year. 77 pleasanton and 80 in pittsburgh and around the
